The natural or legal person who wants to carry out one or more activities in the same center or establishment, or their legal representative.

When can you do?

The communication of the start and substantial modification of activity in an establishment with a technical and certified project is presented before the start of the activity and once the works and facilities necessary to carry it out have been completed and provided that the mandatory prior intervention according to sectoral regulations has ended favorably.

Documents required

1. Technical project signed by a competent technician. In the case of a commercial establishment with a sales area between 400 and 2,499 m2, or a single commercial establishment with an area between 400 and 4,999 m2, the project must also contain: a) plan of situation; b) plan of the floor plan of the establishment showing the sales area with the distribution of the commercial offer and c) plan showing the endowment of minimum parking spaces. In the event that a reduction in parking spaces is justified, the corresponding municipal justification report must be available.
2. In the case of commercial establishments with a sales area between 400 m2 and 2,499 m2 or individual commercial establishments with an area between 400 and 4,999 m2, you must do the processing using the link in the sectionhow is it done?
3. Technician's certificate competent, who is responsible for putting the activity into operation, in accordance with the project presented.

prerequisites

• Have the corresponding license or prior communication of works when applicable.
• The activity to be developed must be compatible with urban planning.
• Have the technical project of the activity, drafted and signed by a competent technician, as well as the technical certificate justifying compliance with the regulations governing the activity, installation or establishment, signed by a competent technician.
• Have all the qualifications necessary for the exercise of the activity. In the case of food and beverage retail establishments; restaurants and food establishments; provision of prepared meals, bars and bars-restaurants, you can check the requirements for food health, in the attached table.
• In the event that the activity to be carried out is considered to be of significant risk in terms of fires, in accordance with the provisions of Law 3/2010 (see the corresponding column “Requires prior report of fires”), prior to making the communication necessary :
  • Obtain the previous report on fires.
  • Once the previous report on fires has been received, a collaborating entity of the Administration must be contacted in order to obtain the certificate of favorable verification act in matters of fires.
  • Have the corresponding certificate of favorable verification in the matter of fires.
• Have paid the municipal fee associated with this procedure.

Communications submitted in accordance with current regulations are effective from the moment you enter the one-stop shop (through the City Council, the OGE or the Business Channel), from which time you can carry out the activity communicated, provided that proof of payment of the corresponding fee is available. The presentation of the communication empowers the Administration to verify the conformity of the data contained therein.

Other interesting information

The communication does not grant the person or company that owns the activity, powers over the public domain, the public service or the collective goods, nor does it provide coverage for effects contrary to current legislation.

If an inaccuracy, falsity or omission of any data or lack of documentation necessary for the start of the activity is detected in the review of compliance with the formal and / or material requirements of the communication, an amendment procedure may be initiated. .

The City Council may incorporate the activity into an inspection plan to verify compliance with the requirements and applicable sectoral regulations.
